Terms of Service

1. Acceptance of Terms

By accessing or using Prontuno (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you’re using Prontuno on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

Prontuno provides transactional email delivery services. The Service allows you to send application emails such as receipts, notifications, password resets, and other transactional messages.

3. Account Registration

3.1 Account Creation

  • You must provide accurate, complete, and current information during registration
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You must be at least 18 years old to use the Service

3.2 Account Responsibility

  • You are responsible for all activity that occurs under your account
  • One person or entity may not maintain more than one free trial account
  • Accounts registered by bots or automated methods are not permitted

4. Acceptable Use Policy

4.1 Prohibited Uses

You may NOT use Prontuno to:

  • Send unsolicited bulk email (spam)
  • Send emails to purchased, rented, or third-party mailing lists
  • Send emails without proper consent from recipients
  • Send phishing emails, malware, or malicious content
  • Violate CAN-SPAM Act, GDPR, or other applicable email regulations
  • Impersonate another person or entity
  • Harvest or collect email addresses without authorization
  • Send emails containing illegal content

4.2 Email Requirements

All emails sent through Prontuno must:

  • Contain accurate “From” addresses
  • Have legitimate, non-deceptive subject lines
  • Comply with all applicable anti-spam laws

4.3 Domain Verification

  • You must verify ownership of domains used for sending
  • You may not send emails from domains you do not own or control

4.4 Enforcement

Violation of this Acceptable Use Policy may result in:

  • Immediate suspension or termination of your account
  • Forfeiture of remaining credits

5. Credits and Payment

5.1 Credit System

  • Service is provided on a prepaid credit basis
  • One credit equals one email sent
  • Credits are non-refundable
  • Credits expire 12 months after purchase
  • Trial credits expire 3 months after purchase

5.2 Credit Rollover

  • When you purchase additional credits before expiry, unused credits roll over
  • Each purchase extends your expiry date by 12 months from the purchase date
  • Credits will not expire as long as you purchase additional credits within 12 months

5.3 Payment

  • All fees are in US Dollars unless otherwise stated
  • Payment is due at the time of purchase
  • We accept major credit cards (Mastercard, Visa, American Express)

5.4 Refunds

  • Credits are non-refundable once purchased
  • We do not provide refunds for unused credits
  • If we terminate your account for cause, no refund will be provided
  • If we terminate your account without cause, we will refund unused credits on a pro-rata basis

5.5 Billing Disputes

  • You must notify us of any billing disputes within 30 days
  • Disputes must be submitted in writing to [email protected]

6. Data and Privacy

6.1 Your Data

  • You retain all rights to the content of emails you send
  • We process your data in accordance with our Privacy Policy
  • We store email metadata and logs for 14 days

6.2 Data Usage

  • We may use aggregated, anonymized data for service improvement
  • We will not sell your personal information to third parties
  • We may access your account to provide support or investigate violations

6.3 Data Security

  • We implement reasonable security measures to protect your data
  • You are responsible for securing your account credentials
  • You must notify us immediately of any security breach

6.4 Data Deletion

  • Upon account termination, we will delete your data within 30 days
  • Some data may be retained for legal or compliance purposes

7. Intellectual Property

7.1 Our Rights

  • Prontuno and all related trademarks, logos, and service marks are our property
  • The Service, including its software, design, and content, is protected by copyright and other intellectual property laws

7.2 Your Rights

  • You retain all rights to the content of your emails
  • By using the Service, you grant us a license to transmit, store, and process your emails as necessary to provide the Service

7.3 Feedback

  • If you provide feedback or suggestions, we may use them without obligation to you

8. Suspension and Termination

8.1 Suspension

We may suspend your account immediately if:

  • You violate these Terms or our Acceptable Use Policy
  • Your account is used for spam or abuse
  • We detect suspicious activity
  • Required by law or legal process

8.2 Termination by Us

  • We may terminate your account for violation of these Terms
  • We may terminate your account with 30 days notice for any reason
  • Upon termination for cause, all credits are forfeited

8.3 Termination by You

  • You may close your account at any time
  • Unused credits are non-refundable
  • You remain responsible for all charges incurred before termination

8.4 Effect of Termination

  • All your rights under these Terms immediately cease
  • We may delete your data in accordance with our data retention policy
  • Provisions that should survive termination (payment obligations, limitations of liability, etc.) will remain in effect

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE ARE NOT LIABLE FOR CONTENT OF EMAILS YOU SEND

10. Indemnification

You agree to indemnify, defend, and hold harmless Prontuno and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content of emails you send through the Service

11. Changes to Terms

We may revise these Terms of Service at any time. Changes will be posted on this page, and your continued use of the service indicates your acceptance of the updated terms.
